Malaika Kids UK Run to the Beat 2010 Terms & Conditions of Entry

By applying for a place on the Run to the Beat (“the Event”) with Malaika Kids UK, as run by IMG UK Ltd (“IMG”), you are agreeing to be bound by the following terms and conditions.

1. You will pay the entry fee of £30 (“the Entry Fee”), which is non-refundable, and you pledge to use the best of your abilities to raise as much sponsorship as you can for Malaika Kids UK and a minimum sponsorship of £350.

2. If for any reason you decide that you cannot participate in the Event, you must inform Malaika Kids UK immediately and use your best endeavours to find a replacement. The replacement must also register with Malaika Kids UK, agree to Malaika Kids UK’s and IMG’s Terms & Conditions, pay the Entry Fee and make the same fundraising commitment. If you and we are unable to find a replacement in the timescale permitted by IMG UK, we will ask you to donate to Malaika Kids the difference between the cost we have paid for a charity place for this event (£69) and your Entry Fee (taking into account any sponsorship you may already have raised).

3. It is a condition of entering the Run to the Beat that you must read and agree to the IMG Participant Terms & Conditions.

4. You acknowledge that the Event will be physically strenuous and that participating in the Event will be physically demanding. You warrant that you are physically capable of competing in the Event.

5. You consent to being photographed, filmed or recorded by IMG or anyone authorised by IMG and the use and reproduction of your likeness in film, brochures or recordings.

6. You agree that you will take out personal accident insurance in respect of your participation in the Event to cover any personal injury to yourself, injury to others and consequential loss, howsoever caused. IMG or Malaika Kids UK are under no obligation to provide such insurance.

7. Whilst the Entry Fee is non-refundable, Malaika Kids UK will consider whether to provide a refund on a discretionary basis. Any claim for a refund must be directed through Malaika Kids UK and not to IMG.

8. You will not bring any claim, whether arising now or in the future, against IMG arising out of or in connection with the Event for any losses, costs, damages or expenses of any kind (including professional fees).

9. Except to the extent that liability may not be so excluded under applicable laws:

(a) Malaika Kids UK is not legally responsible for the actions of IMG.

(b) Malaika Kids UK’s liability under or in connection with this agreement, whether arising in contract, tort, negligence, breach of statutory duty or otherwise, shall be limited to the Entry Fee that you have paid, save in the case of death or personal injury caused by Malaika Kids UK’s negligence.

(c) Malaika Kids UK will not be liable to you in any circumstances in contract, tort, negligence, breach of statutory duty or otherwise for any loss, damage, costs or expenses of any nature whatsoever incurred or suffered by you of an indirect or consequential nature including without limitation any economic loss or other loss of earnings, turnover, profits or business.
